This group of records includes the governance of the Guild after the Municipal Corporations Act was passed, admissions to Freedom of the Borough, legal disputes with the Town Council and others over the extent of Freemen rights and lands and the administrative records of the Freemen Trust that was established to protect their interests and manage their assets. There is also a series of deeds and property titles: full access to these is restricted because recent transactions may contain commercially sensitive information. Expand H - Berwick-Upon-Tweed Record Office - BA/H - BOROUGH OF BERWICK-UPON-TWEED, NORTHUMBERLAND: RECORDS: HARBOUR AND HARBOUR COMMISSIONERS  - The Berwick-upon-Tweed Harbour Commissioners were established by Act of Parliament in 1808. They were appointed to encourage the development of the harbour, overseeing major improvements to the pier, quay and docks and still manage the harbour today. Berwick Harbour and the revenue derived from Harbour Dues was managed by the Corporation before this Act was passed.  The collection of Harbour Dues passed to the Commisssioners from 1808. The Corporation purchased the Manor of Tweedmouth and Spittal in September 1657 and, through their right to wharfage there,  was able to inhibit development of the south bank of the Tweed to protect their interests. The pre-1600 Bailiff Court records are in BA/G because the nature of business is largely Orders in Council and petitions/complaints for resolution by Mayor and Bailiffs or their referral to the Governor of Berwick-upon-Tweed to enact or enforce. The Governor was the Crown representative in Berwick when martial law was operational and the focus was on the management of the Garrison and billeted soldiers. The Town Officials had no jurisdiction over them or the Crown property in Berwick and had to petition the Governor to take action through his officers.

There are two series of official Court Books and Files that are distinguished according to the different actions brought i.e. Pleas of Debt and Trespass or Pleas of Land. There is rarely such a distinction at bundle level in the court process papers. Expand 2 - Berwick-Upon-Tweed Record Office - BA/J/QS/B/2 - BERWICK-UPON-TWEED QUARTER SESSIONS: CIVIL JURISDICTION: SACRAMENT CERTIFICATES AND OATHS OF ALLEGIANCE - The Test Act (1673) required every person holding a civil or military office to receive the sacrament of the Lords Supper (following the  rites of the Church of England) within six months of their appointment. On doing so, a certificate, signed by Minister, Churchwardens and two witnesses was delivered to the Court of Quarter Sessions. This provided confirmation that both the oath of office had been sworn and that a declaration denying the doctrine of transubstantiation had been made. The Act was repealed in 1828 and was replaced by a succession of revisions that essentially required the office bearer to swear allegiance to the monarch.
To counteract the conspiracies against the crown by the Stuart claimant to the throne and followers an Act of 1722 required all persons to take the oath of allegiance, if they had not already done so, by Dec. 1723 or register their names and real estate  in the same way as papists (see Register of Papists Estates BA/J/QS/B/5). An amendment extended the deadline to Nov 1724 and confirmed women were not obliged totake the oath.
